It is a Sunday and I am working as are millions of others trying to ease the anxiety and concerns our clients, friends and family have. Below is BMD’s Stimulus Package Recap as well as a link to our COVID-19 Resource Page. In short, 3 key takeaways:

  1. Employers with cashflow issues can delay payment on a rush of Emergency Paid Leave in the first 2 weeks of April.
  2. With proper planning, the entire Paycheck Protection Program loan of 2.5x monthly payroll may be forgiven.
  3. Small businesses with fewer than 50 employees will be able to deny Emergency Paid Leave requests, but that does not necessarily mean they should.

Lastly, I am attaching a Client Alert regarding the healthcare and emergency responder exceptions to the required paid leave under FFCRA. These exceptions are quite broad and are intended to keep healthcare employees working. However, the one question that remains unanswered by the guidance is whether healthcare providers performing non-essential services, potentially in violation of state order, meet the leave exception under FFCRA. Based on the language of the FFCRA and the guidance published this morning by the DOL, we believe that the answer is yes. These providers are not required to receive paid leave under FFCRA. Keep in mind, this does not override any state orders regarding the performance of non-essential healthcare services.
